Writing a will might not be top of your 'to do' list, however there are very good reasons why having a will is important.

A lasting power of attorney (LPA) is a document which is drafted whilst you have relevant capacity, to appoint somebody you trust to act as your attorney and make decisions relating to your affairs if you are unable to do so yourself. There are two types of Lasting Power of Attorney, one related to Property and Finances and one for Health and Welfare.
An enduring power of attorney (EPA) is a document that appoints someone to manage your property, money and financial affairs. The EPA was replaced with the property and financial affairs lasting power of attorney (LPA) in 2007. If you made an EPA that was signed and witnessed before October 2007 you can either continue to use it or cancel it and set up a property and financial affairs LPA.
If a friend or family member no longer has capacity to put in place a Lasting Power of Attorney but you need to handle their affairs then we can assist you in making application to the Court of Protection to be appointed as their Deputy. This will then allow you to access their accounts etc to ensure that all bills are paid and any benefits or income are properly received.
If you feel comfortable in dealing with the administration of an estate but would like us to obtain Grant of Probate on your behalf to enable you to then close accounts or sell property etc we can do this on a fixed fee basis. This will include completing the inheritance tax return and submitting application to the Probate Registry for the Grant of Probate.
If you would prefer for us to deal with the whole administration of the estate on your behalf we will take matters from initial notification to asset and liability holders through to obtaining Grant of Probate, selling any property, closing any accounts, paying any debts and then distributing the net estate between the beneficiaries in accordance with a Will or intestacy rules. We will also handle the tax affairs relating to the estate.
